Hi guys,
My I140 was approved last week (RD July 2007). I have the approval notice copy from the lawyer but the online status is still saying its pending.
I called uscis and she told me that she is seeing that its pending too but if i have the approval notice then not to worry. It takes them some time sometimes to update the system, as per her.
But my concern is, when my PD becomes current and if their own system shows my I140 penidng(eventhough it's approved), how will they approve 485?
Any one in same boat or any past experience?

now-a-days, Online system is not in sync with the case system. Level CSR will see what you see on online system. As long as you have the hardcopy of the approval, you are good to go. Someday, online status will change.

Hi ,
I got my H1B extension done and seeing issues with that, please can somebody help me out on this ASAP. My old I797 is valid till June 14th 2010 , when I went to India I got an I-94 issued at port of entry which has the date June 24th 2010.
Now my current I797 has been approved from June 25th 2010.
What is my status from Jun 14th to June 25th ? Am I in status because I have a I94 valid till June 24th or will I be out of status for those 10 days ?
Can I work and have my payroll run for hose 10 days (June 15th to June 24th)
Please respond ASAP as I have very short time to act on.

AILF's Legal Action Center has a class action lawsuit completed and ready to file against the Department of Homeland Security and the Department of State for their unlawful actions in the I-485 / Visa Bulletin mess. The government improperly denied tens of thousands of intending immigrants the opportunity to apply for employment-based visas known as "green cards."
Rumors continue today that the Administration will be announcing a decision regarding their proposal to resolve the crisis. The most recent rumors indicate that the announcement will be made today. However, there are widely varying reports on what the proposed solution will be.

I always follow his articles.
I always felt that CIR was a impossible strategy. It bundles all the immigration bill in one single bill. The idea is that it would make the illegal legalization process more easier than in a piecemeal strategy where the easily passable ones like SKIL bill etc might pass leaving behind the more politically toxic rest.
Also what it does that it makes the CIR an isolated elephant which is hunted down by
a pack of wolves , in other words uniting the antis into one single consolidated powerful force.
Eventually the MALDEF head is realizing the folly of the logic and I feel in a Year or two CIR strategy will be abandoned for a piecemeal strategy.

Hi All,
I had a question regarding the relationship between the number h1b transfers and green card process. I've heard some people say that if you have transferred H1b to many companies then the green card process will be delayed because USCIS needs to be convinced that you will be continuing with the same employer. Is this true or does it really not matter how many times you change employers it doesn't effect the green card process.
I have already transferred once. I am thinking of transferring one or possible two more times but am just worried about how this will effect the green card application process.

Hi. I just e-filed my I-539, status of change request from F-1 to H-4. I just found out that I chose "North Korea" for my citizenship, while it was supposed to be "South Korea". I chose "South Korea" for the passport issuance country.
How can I fix this? Should I attach a letter explaining this, when sending the supporting documents? What else supporting documents should I submit, other than my husband(H-1)'s paystub, I-129 approval notice and our marriage certificate?

you need to write a covering letter describing your mistake and mention all the supporting documents
Supporting documents can be
1. your passport
2. your husband passport with your name mentioned on it
3. your birth certificate
4. your educational certificate (if it specifies your country of birth)
I would suggest to send at least two or three supporting documents which shows your date of birth.
In fact I did the same problem and I had to send the supporting documents.

First of all, let me begin by congratulating the IV core team and other members on staging a dignified protest to the entire July VB fiasco!
I have a question regarding the medical exam for the AOS. The civil surgeon I went to did not do a TB skin test and instead took an x-ray to verify no signs of TB. Has anyone else had the same experience, i.e. no skin test, x-ray only?
The other strange thing he told me was that some of his patients send the x-ray as part of the 485 application. Has any1 else heard of anything like this?
Last I checked, the USCIS did not employ medical personnel, but then what do I know?
Any input from fellow IV members is greatly appreciated.

I had my stamping done in Delhi last year in September. They just asked me the following:
1. Latest Paystubs.
2. W2.
3. Client name.
4. My responsibilities at work.
5. How long have I worked at my employer.
All this took just a couple of mins. One of my friend also got his stamping done in Delhi in Dec last year.
Just carry all documents you can. They will not be needed, but you be more prepared and confident at the interview.

Are you married to a USC? If so, you have nothing to worry about. Do not travel until your GC is approved as AP is not 100% safe for people that overstayed.

I will be travelling outside US using AP by end of this month. I don not have valid stamped visa. Recently small part of my old company (A)got acquired by new company and my job was moved to new company (B)
Lawyer at company B applied for New H1 in May 2008 ( old is still valid till 2009)�but haven�t received approved 797 notice yet.
Can I travel outside US and comeback without haveing approved new 797 notice. I do have EAD and old 797.
Any issues ? I don�t want to abandon my H1 status.
Gurus please advise.

My wife came to US on H4 and changed to F1 status thru COS. She is doing Masters 2nd semester and went for F1 visa stamping this week in India. She got 221(g) pink slip asking explain her projects, plans afer study etc. Visa officier withheld her passport and I20.
BTW the way I am on H1B and provided all the financial support documents.
I searched the online didnt any F1 getting 221(g) pink.
1)If anyone else got this for F1 please share your experiences and any tips.
2)How long it takes after repsonding to thier queries
3)what are the chances getting visa after getting 221(g) pink
4) Do you suggest getting any professional in drafting the reponse to te queries.. if so do you know any one in Hyderabad, India

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.
