How long will it take to get the receipt number when we apply for H-1 extension? And how long will it take to get the decision?
I am assuming when I have the receipt number, I can be considered to be in legal status and keep working with my present employer though I-94 is expired.
Please help with your answers/suggestions.

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. I have a question. I have a student visa now from last 4 years and before these student visa I started a small business in India. i didnt expected it to grow much but now it has grown. I have used money from that business for my 2nd MS which is not completed yet
Here is the problem
I am getting married in May. Till May I can stay here legally but than once I leave and get married I want to come with my Wife. So I have 3 options
She apply alone for visitor visa ( chances are less for these)
She come as dependent ( I dont have any income here or any source of income from college)
I leave my student visa and we both apply for visitor visa. These option has a lot of risk but its the best I am thinking as I am not interested in going to college anymore
What you think which route I should take?

Great Analysis from AILA to share with our readers. PL 111-230 requires the submission of an additional fee of $2,000 for certain H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) and $2,250 for certain L-1A (http://www.h1b.biz/lawyer-attorney-1137416.html) and L-1B petitions postmarked on or after August 14, 2010. Petitioners subject to this new fee include employers with more than 50 employees in the U.S., for which 50% of their workforce is on H and L visas. The fee will remain in effect through September 30, 2014.
USCIS indicated that Vermont Service Center and California Service Center were instructed to hold any H or L petitions sent after that date, pending guidance on how to determine whether the petitioner is subject to the new fee. USCIS will be modifying the I-129 or H-1B Data Collection Form to include information on whether this fee applies.
In the interim, USCIS suggested that petitioners could proactively include a �certification� regarding the fee, including a notation of whether the fee is required in bold capital letters at the top of the cover letter. The sample certification that the petitioner is not obligated to pay the fee would be:

As you already know, the H4 is only valid as long as your H1 is valid. If companyA has a policy or if in future they decide to revoke h1, then you may not even know.
If I were you , I will go ahead and file for h4 transfer too.

Hm.....................................
It thus appears that those who are scheduled for IV interviews should keep the schedule of interviews in July regardless of the current Visa BullEtin fiasco. Readers may also ignore our previous message on the consular processing. It is an extremely confusing time. Please check the visa interview appointment letters from your American consulate. Please stay tuned to this website for further information on the IV consular processing.

If the I-94 was not given a full year's validity due to passport expiring within a year, Is the I-94 still valid after its expiry?
As far as I-94 goes it will expire but since you are already in AOS status, it really does't matter.

thanks!! it's always good to hear that i'm improving from someone as good as yourself. it was funny, as i was going back the dirt road, the party kids from the night before were on there way out, they don't know what they missed this morning.
That's why you get up at 4:30! My friends make fun of me for that... The successive ridgelines in the fog make for a real feeling of depth. I've tried that technique a few times, but never pulled it off this well. I also like the aspect ratio you chose, it contributes to the 3-D, receeding-to-a-point, effect. The color here is likewise very nice. The only thing I would say could be better is that the sun is distorted by the cloudline. It would be better if totally obscured, or better resolved. In any case, you can't control the clouds. Super shot.

You can go to any industry financial, insurance, pharma etc but your job and duties should be similar to your current one. If your current position is *mathematician* and your new job says "consultant" it will catch the officer's attension easily. But from other threads in understood that your job description should be similar to your current ones. Please go thru some IV threads.

Thanks fromnaija, do you know if it's going to take the same amount of time the get the corrected EAD or is it going to be longer than regular time, I know it depends on the service center and the processing dates, but just curious if you happen to know any such cases and the time USCIS took to process them.
I hope I don't need attorney's help in this as I have been renewing EAD since 2004 myself.

I haven't had "any" FP yet, but I have my EAD and my advanced parole for tavel. I also have my H1B current and stamped in my passport.
Last time I got H1B stamped in the embassy, they took my fingerprits, 10 fingers (I also asked if they want the 10 toes :D)
Can that fingerprinting in the embassy be the reason why they haven't sent any notices for my fingerprinting?
Should I be worried?
Can somebody, please, tell me how do you ask for a service request?

Did they take the print of your four fingers (excluding the thumb) together? If not, then the fingerprinting you underwent was not the same.

I actually spoke to my candidate and he will now be using the premium service for his H1B and then resigning since he can transfer.

Function Overloading. You can create an instance of the class with either one parameter, or two since it is being defined there. In their example they used two, but they could have used one and not received an error. Search for function overloading and it should explain much better than me.

It depends on your Service Center. For TSC, you can have your EAD after 11 weeks from Receipt. For NSC, you can have your EAD after 12 to 14 weeks from Receipt.

mine was 3 years ago. i got a respond from them in favor of me in about a month. however USCIS status page still shows as pending. Go figure.
