If we have more people like you we can work on trying to get the eligibility start time for citizenship counted from the time I140 gets approved rather than the day you get Greencard.
This maybe a big change and even help us politically as more people will become citizens earlier and can vote.
This is something for all IV GC holder members and all other GC holders everywhere to think about. They are invited to have a dialogue and participation in such an effort if interested.

As mentioned by Administrator2 to report any issues with the tracker on this thread, here are issues I found.
1. I tried to sort the listing on Priority Date. The issue is that it does alphabetical sorting and not sorting according to the date. It displays all members with Apr-01, then Apr-02, then Apr-03 instead of Apr-01, May-01, Jun-01 etc.
2. Also, right now, one can just go back or forth 2 pages at a time. say if you are on page 5, it displays page 3,4,5,6 and 7 as links. It would be nice to add a longer list of pages to jump to or a drop down/text box to jump to a desired page number would be better.
Nice work to add this tracker...this will prevent all the different polls popping up.

My 140 was filed in Nov 2006. I had to wait 2 full years before my case got approved in Nov 2008.
My lawyer did not even open a service request. She was against infopass too. Her reason was that these would work for any other case except 140.
Based on my experience, I would recommend the following:
1. Ask your lawyer to go through AILA. This is the most preferred way and should work in 99% of the cases (This is what worked for me though it took a lot of time)
2. If option 1 does not work, try to go through your local congressman.

Yellow Admin Review is usually TAL (Technology Alert List) check. This kind of makes sense with your Chemical background. This is usually faster check compared to other types (like name-check). This used to take 21 days, you are around the same timeframe.

People can only give mere advise, but you are the one who is going to take the final decision that is right for you.
The person who can answer some of your questions is nobody, but you.
IMO, the market is not as good as you think, and it�s going through the worst recession ever.
If not at your current job, you may have to take a pay cut at your future job, because that�s the current economic reality.
Since you have asked� I would suggest you to stay where you are and float your resume in the market and see the kind of response you get. I hope you will have a better idea then.

Payroll tax is same as employer tax. There are 2 or 3 components of the taxes that employer pays such as Social security ( employer portion), unemployment tax, Medicare ( employer portion)
also employer will need to pay for payroll company such as ADP a fee to maintain payroll, do filings

A US company is a US company, be it Microsoft, or Cap Gemini, or whatever. For all you know, you may be working with Oracle's consulting division. Are you considered direct employee for Oracle or from a consulting company?
I have friends from Microsoft and Oracle who just got approved after 7 years + in EB2. I also know people from Consulting companies who got approved in 4 years.
I do not think there is any logic or facts to support this argument.

I submitted Proof Of Status along with my I-485 as my lawyer asked for it.. Not sure if everyone does... It was a statement (1 page word doc) with all my H1/I-94 history... I was missing few I-94 numbers, I left it blank... And attached all my H1B copies along with it...
Remember that your I-94 # changes only when you tarvel outside US... So it should be quite simple to keep track... I-94 # is also written on your H1 extension if done while in US... So I was in nutshell able to get most of my I-94 numbers.. except for one duration when I travelled on same H1 twice.. So lost that I-94 #.. But had same H1B for that duration.. SO guess it should be okay...

Yes. I guess, I read it wrong. I'm surprised that USCIS has outsourced this work to companies like these trusting them blindly. I was of the impression that the attorney used some USCIS website to file for PERM labors. And what kinda stupid co. was this...TESTING against prod database? Scary :eek:
USCIS didn't outsource; at least not to LawLogix. They are independent SW makers, much like TurboTax from Intuit :)

Let me start off by saying this is simply not the right forum for such discussions. You are better off using monster.com or some other job related sights.
As far as changing the fields go, assuming you have the authorization to work - you can change. But QA jobs these days are hard to come by and mostly happens in different countries and most of the existing jobs have been bangalored. And an effective QA job requires some kind of experience in the software development or related field. A non effective QA job is simply testing and chances of you retaining the job for more than 2 years is very slim. The thinking behind that is a more person gets involved with testing, the more he/she understands the testing and less rigorous the testing becomes.
SAP courses are good once you understand the nuts and bolts. But its challenging and requires you to have lots of people skills and ability to convince people that their business must run per SAP and not viceversa. Hope that helps. Good luck.

However my F1 visa expires May 30 2009.
Also I do not have a job at present.
Does my OPT override the F1 visa expiration?Can I stay legally in the US till August even if I do not have a job?

The visa stamp on your passport does not determine your status once you are inside USA. Visa stamp on the passport is used just for entering the US. It is like a movie ticket. You will need the visa stamp on the passport only if you go out and need to come back again. The expiry date on the visa stamp simply means you cannot use that stamp to enter US after that date.
Once you are inside US, usually it is I-94 that determines how long you can stay. In the case of F1, usually I-94 says D/S, which means "Duration of Status" --- i.e., as long as your F1 status holds according to I-20, you are good. OPT is a part of F1. So as long as you do not stay beyond the date of OPT expiration, you are good.

You can work with your HR and lawyers in creating a better job description. Here are some points that I would consider in creating a job description that is honest and flexible...
1. Job should be for future placement (say, in 3-5 years time)
2. Job should offer you reasonable career and skill growth
3. Job should not be constrained to a single geographic location in US
4. Job title should match one of the broad skill categories of DOL (this would allow you to change jobs without having to worry about implications on labor certification)

Dude, It is only fair to say that your employer is entitled to keep his money, but if you are worried about not having pay stubs to prove your continuous employment then you work it out with your employer, pay back his money and get your salary. It won�t be easy cause you have already pissed him off.
